Qualification, registration, and authority to practice
Florida broker licensure requires qualifying experience, the applicable broker education, a qualifying application, and passage of the broker examination. A sales associate seeking broker licensure must complete required sales associate postlicensure education and hold a current, valid license. Registration records the licensee's business or employment relationship; it does not replace the qualification for a license or make an inactive license active.
A broker may operate a brokerage. A broker associate has broker qualifications but works under another broker. A sales associate or broker associate may work for one broker or one owner-developer. A group license accommodates affiliated owner-developer entities under substantially common ownership or control, with each entity executing the required certificate. It does not authorize employment with unrelated brokers. A broker operating for more than one brokerage entity needs the appropriate multiple broker licenses, a different concept from a group license.
Keep status separate from credentials
An active license authorizes practice in the properly registered capacity. Voluntarily inactive status is chosen; it can be renewed while remaining inactive. Failure to renew sends an ordinary real estate license into involuntarily inactive status. Neither inactive status authorizes brokerage practice.
Under section 475.183, involuntary inactivity of 12 months or less requires at least 14 hours of prescribed continuing education for reactivation. More than 12 but fewer than 24 months requires 28 hours of prescribed education. More than 2 years of involuntary inactivity causes automatic expiration and null-and-void status. Education is not the entire process: applicable renewal and late fees also matter. Do not interpolate an unstated boundary rule.
Renewal and accurate records
Ordinary active-license renewal includes an application, fee, and evidence of the required continuing education. First renewal has a distinct postlicensure requirement. A broker who fails to complete required postlicensure education before first renewal has a null-and-void license, rather than merely an ordinary late-renewal problem. To operate as a broker again, that person must requalify through broker prelicensure education and the state broker examination. The statute also permits a sales associate license after proof of the specified 14-hour continuing education course completed within 6 months following expiration of the broker license.
Keep employment and business registrations accurate. Notify the department in writing within 10 days after a mailing or email address changes. The mailing address receives postal mail; the place of practice is the brokerage's physical office. A license certificate, a completed course, and a registered employer each answer a different question. Check all relevant requirements before performing brokerage services.
