Taxing jurisdictions, special assessment districts, and exemptions

Identify the jurisdiction and the function

A New York parcel may be subject to county, city, town, village, and school district taxes, depending on location. Several taxing jurisdictions can use an assessment prepared by one assessing unit. Assessment and collection are separate functions.

Under Real Property Tax Law § 102, an assessment determines valuation, including the valuation of exempt property, and whether property is subject to taxation or special ad valorem levies. Assessors make assessments; collecting officers receive payments; boards of assessment review hear assessment complaints.

A New York parcel connects to three boxes: ordinary municipal and school taxes, special district charges consisting of benefit-based assessments or special ad valorem levies, and exemptions whose owner qualifications and affected levies must be checked separately.
Identify the charge before applying an exemption.

Distinguish special district charges

A special district provides or finances improvements or services benefiting its inhabitants or real property. Water and sewer improvement districts illustrate the concept.

  • A special assessment charges benefited property in proportion to the benefit received.
  • A special ad valorem levy charges benefited property in the same manner and at the same time as municipal taxes. New York's definition excludes charges imposed by or on behalf of a city or village.

Both can cover operation and maintenance, not merely initial construction. Section 102 generally distinguishes these charges from ordinary municipal and school taxes, although its definition includes special ad valorem levies as taxes for specified levy and collection purposes.

Match the exemption to the charge

Verify the program, local adoption, application requirements, and affected levies with the assessor before estimating a buyer's bill. A seller's exemption does not establish the buyer's savings.

Veterans: Real Property Tax Law § 458 provides a mechanism to adjust an existing exemption after a qualifying revaluation and certified change in assessment level when the required local law is adopted. An increased exempt assessment is not an equal cash refund.

Senior citizens: Section 467 includes a procedure for a qualifying purchaser acquiring property after taxable status date but before the tax levy to apply within thirty days of title transfer.

STAR: School Tax Relief concerns school taxes. Section 425's transition rule restricts exemption approvals based on ownership and exemption status on the roll used for the 2015–2016 school year. Distinguish that exemption from the personal income tax credit route. When an administrative error omits an eligible STAR exemption and causes excess school taxes, the commissioner may pay the lost savings directly. That payment cannot be combined with a refund for the same error.

Identify the assessing function, the kind of charge, and the applicable exemption separately.
