Zoning laws, variances, and code enforcement
Lesson 87 of 87 · All lessons
Zoning and the plan
Zoning uses government police power to regulate land uses, density, height, setbacks, lot coverage, and parking for public health, safety, and welfare. The comprehensive plan supplies the broad development framework; zoning and other land development regulations implement it. Private deed restrictions impose separate obligations.
In Florida, the local planning agency prepares the comprehensive plan or amendment and recommends adoption to the governing body. Before its recommendation, it must hold at least one public hearing with public notice. Recommendation is distinct from final adoption.
Choose the correct approval
- Rezoning changes a parcel's zoning classification.
- Variance grants limited relief from an ordinance requirement, typically for a qualifying hardship tied to unusual physical characteristics of the property. An oddly shaped lot may support a setback request; a desire for greater profit is not itself a property hardship.
- Special exception or conditional use concerns a use already contemplated by the ordinance, subject to specified standards and approval. A child care center requiring traffic and parking review is different from a request to change the district classification.
Local terminology, criteria, decision makers, and procedures vary. Verify the applicable ordinance and written approvals rather than promising approval.
Existing uses and separate controls
A legal nonconforming use was lawful when established but no longer conforms after a zoning change. It differs from a use that was unlawful from the start. Continuation does not necessarily authorize expansion, rebuilding, or resumption after abandonment. Years of operation alone do not prove lawful status.
Zoning approval addresses use and site arrangement. Building regulation addresses construction standards. Private restrictions address separate recorded obligations. Passing one does not settle the others: a setback variance does not waive structural safety requirements.
Enforcement and due diligence
Code enforcement addresses violations through the applicable process, including notice, an opportunity to respond, and potential corrective orders or penalties. Inspect the property and check official records for permits, approvals, and unresolved violations.
For a Florida development agreement, a party or qualifying aggrieved or adversely affected person may seek injunctive relief in the circuit court where the local government is located to enforce its terms or challenge statutory compliance. This specific remedy is distinct from requesting a variance.
