History of Florida real estate license law and the statutes and rules that govern it

From licensing to a commission

Florida enacted its first real estate license law in 1923 and created the Florida Real Estate Commission (FREC) in 1925. Licensing developed to protect the public in real estate transactions. Historical milestones explain the system's origins; current obligations come from the law in force today.

Three legal addresses

Chapter 475, Part I, Florida Statutes, is the real estate practice act for brokers and sales associates. Chapter 455, Florida Statutes, supplies general provisions for professions regulated by the Department of Business and Professional Regulation (DBPR). Chapter 61J2, Florida Administrative Code, contains FREC's implementing rules.

Two top boxes identify Chapter 455 as general professional regulation and Chapter 475, Part I, as the real estate practice act. Lines lead to Chapter 61J2, the commission rules that implement delegated statutory authority. Statutes provide the legal foundation for these rules.
Statutes establish authority; commission rules implement it.

The legislature enacts statutes. FREC adopts rules within delegated authority. Section 475.05 authorizes rules implementing laws that confer powers or duties on the commission. A rule cannot override a statute. Private association standards are a separate category; they are not Florida statutes or FREC rules.

A rule in action

Rule 61J2-2.029 sets a passing score of 75 out of 100 points. For the sales associate examination, it allocates 45 points to law, 45 to principles and practices, and 10 to mathematics, to the extent those areas can reasonably be separated. This illustrates a rule implementing statutory authority.

Check the scope

Chapter 475 also contains appraiser provisions. An appraiser credential is distinct from a sales associate license: do not transfer requirements between them merely because they share a chapter. General licensing provisions and real estate-specific provisions can apply together. Identify the activity, find its governing statute, and then consult the implementing rule.
