Protect informed choice

Explain needs, costs, limits, and access to funds plainly. Allow questions and avoid pressure. The supplied excerpts do not state every product-specific senior protection; check the applicable free-look, suitability, and replacement requirements separately.

California home meetings

For life insurance, including annuities, sales, offers, and lead generation, deliver the initial home-meeting notice 24 hours to 14 days before the meeting. If a senior with an existing insurance relationship requests a same-day meeting with that agent, deliver notice before the meeting. The notice is a stand-alone document without attachments, in 16-point bold type, containing the prescribed information and no extras. It identifies the agent, license and contact information, purpose, attendees, and rights to have others present, end the meeting, and contact CDI.

After a greeting, disclose the insurance purpose before other statements or questions. Identify arriving persons and titles, and the insurer if known. Each attendee supplies written identification. End discussions and leave immediately if asked. Do not disguise a sales contact as another mission.

Three checkpoints guide a California senior home meeting. Before the visit, provide required notice twenty-four hours to fourteen days ahead; an existing customer requesting a same-day meeting receives notice before it begins. At the door, disclose the insurance purpose and identify the people involved. During the meeting, respect the senior's control and leave immediately if asked.

Credentials and truthful explanations

A senior designation requires current authorization by its issuer, commissioner approval, and at least four years licensed in a state or U.S. territory for the insurance types involved. It must not mislead. Covered writings require California insurance license identification immediately before the license number, in the same font and at least the designation's type size. Policy terms, benefits, and future dividends must not be misrepresented, including statements the speaker should know are false. A projection is not a promise.

Medi-Cal-related annuity sales

California prohibits specified senior annuity sales intended to affect Medi-Cal eligibility: when assets are at or below the community spouse resource allowance, when the senior would otherwise qualify, or when the purchase would leave the senior or spouse unable to qualify. An issuer of a prohibited fixed annuity must rescind and refund premiums, fees, contract interest earned, and costs.
