Government-backed loans, SONYMA, and the secondary market

Separate the program from the market

A New York buyer may encounter federal mortgage programs, a New York state program, and institutions in the secondary mortgage market. These describe different roles. FHA mortgage insurance and VA loan guaranties support qualifying loans. SONYMA, the State of New York Mortgage Agency, is a state program that helps people finance homes. The secondary market supplies liquidity by connecting mortgage investments with capital.

FHA and VA

The Federal Housing Administration, or FHA, insures mortgages. Mortgage insurance concerns the lender's credit risk; it does not pay for physical damage to the house. Under 12 U.S.C. § 1709, FHA insurance includes mortgage insurance premiums. Compare the interest rate, premiums, and other charges when evaluating borrowing costs. A lower note rate alone does not establish a lower total cost.

Section 1709 generally requires an individual borrower using the covered one- to four-family program to occupy the property. A permitted secondary residence requires a hardship determination and cannot be a vacation home. Do not confuse a statutory exception with permission to finance an ordinary vacation purchase.

The Department of Veterans Affairs, or VA, guarantees qualifying loans. Under 38 U.S.C. § 3710, authorized purposes include purchasing or constructing a veteran's home, improving an owned and occupied dwelling, and certain refinancing. A condominium purchase must involve a project approved under the Secretary's criteria. Program authorization is not a promise that a particular applicant or property qualifies; confirm the applicable requirements with the lender.

SONYMA and the secondary market

SONYMA is New York's state home-financing program. Keep it separate from federal FHA insurance and VA guaranties. No single rate or assistance amount describes all state program transactions.

In the primary mortgage market, a lender originates a loan to a borrower. In the secondary market, existing mortgages or interests in mortgage pools are sold to investors. Selling loans can replenish a lender's funds for additional lending. Servicing means collecting payments and administering the loan; it is distinct from owning the loan.

Fannie Mae and Freddie Mac purchase mortgages and support mortgage securitization. Ginnie Mae guarantees timely payments of principal and interest on qualifying mortgage-backed securities; that securities guaranty is different from FHA insurance on an individual mortgage. The federal purposes in 12 U.S.C. § 1716 include secondary-market stability, greater liquidity, and wider access to mortgage credit.

A lender originates a loan to a borrower in the primary market. The lender can sell the existing mortgage into the secondary market. Investors supply capital in return, replenishing lender funds that can support additional lending.
Origination creates a loan; secondary-market sales circulate mortgage capital.

For an exam question, identify the role first: FHA insurance, VA guaranty, SONYMA state assistance, primary-market origination, or secondary-market investment.
