Permission, site, and structure
Zoning governs permitted uses and development limits such as setbacks. Building codes govern construction and safety. A building permit authorizes specified work, inspections check required stages, and a certificate of occupancy identifies approved occupancy or use after the applicable approval process. A permit alone does not establish that an addition is approved living space. Local requirements and existing-building documentation vary; verify records with the responsible building authority.
New York's Uniform Fire Prevention and Building Code establishes construction and fire safety standards. The state fire prevention and building code council formulates the code. Local governments generally enforce it and the State Energy Conservation Construction Code, with statutory arrangements for another authority to take over. New York City has its own building code system. Energy compliance is distinct from structural compliance.
Site suitability
Consider soil bearing capacity, slope, drainage, access, and water and sewage arrangements. A survey establishes boundaries and locates improvements; a soil investigation evaluates ground conditions. Grade should direct surface water away from foundations. Setbacks measure separation from lot lines, not soil strength.
Building components
Footings spread loads over supporting soil. Foundations transfer loads to footings. Joists support floors; beams support other members; studs commonly frame walls. A load-bearing wall supports loads beyond its own weight, while a partition primarily divides space. Rafters or engineered trusses support roofs. Sheathing covers framing. Flashing directs water away from vulnerable joints. Insulation slows heat transfer; ventilation and moisture control perform related but distinct functions. Sound construction and required approvals are both necessary: neither substitutes for the other.
New York construction notices
Residential permit applications using truss type, pre-engineered wood, or timber construction must identify it and include the prescribed designation form. The local government notifies the fire protection authority. If an exterior electric box exists, the approved sign or symbol must be affixed as a condition of final receipt of the certificate of occupancy or completion. The owner or representative maintains it. A salesperson recognizes these issues, checks approval records, and refers structural evaluations to qualified professionals.
Key terms
Sample questions
Which document primarily authorizes specified construction work before that work proceeds?
Reveal answer
Correct answer: Building permit
A building permit authorizes the described work. Occupancy approval serves a later, different function.
A buyer asks whether a house meets the minimum distance from its side lot line. Which concept answers that question?
Reveal answer
Correct answer: Setback
A setback governs separation from a lot line. It does not measure structural strength or energy performance.
Which body formulates New York's Uniform Fire Prevention and Building Code?
Reveal answer
Correct answer: State fire prevention and building code council
Exec. Law § 377 assigns formulation of New York's Uniform Code to the state fire prevention and building code council.
