California replacement: information before a decision
Replacement can involve surrender, reduced benefits, nonforfeiture values, or borrowing exceeding 25% of policy loan value because of a new purchase. The agent must consider what is known or should be known, not merely what the transaction is called.
Application and notice
Each application requires the applicant's signed replacement statement and the agent's signed statement about known or possible replacement. When replacement is involved, present the replacement notice no later than taking the application. Applicant and agent sign; leave it with the applicant. Identify every contract being replaced by insurer, insured, and contract number, using alternative identification if no number exists. Submit the notice copy with the application. Leave originals or copies of printed sales communications with the applicant.
Insurer follow-through
The replacing insurer sends each existing insurer written notice, identification, and required proposed policy information within three working days after application receipt at its home or regional office, or on issuance, whichever is sooner. An existing insurer undertaking conservation supplies the policyowner with existing policy information within 20 days of receiving the communication and required materials. A copy requested by the replacing insurer is due within five working days of the request. Maintain evidence of compliance for at least three years.
For replacements subject to section 10509.6(d), the delivered contract includes notice of a 30-day cancellation period from delivery. The general refund is all premiums paid. For variable life and variable annuities, it is account value plus any policy fee, refunded within 30 days after notification of cancellation.
Distinctions and violations
Same-insurer replacements retain specified signed statements, notice, and written comparison duties. For direct-response sales, an insurer that proposed replacement gives notice with the application; if it did not propose replacement, notice accompanies the policy.
Materially inaccurate comparisons violate the article in replacement or conservation. Recommending an unnecessary replacement annuity to an insured age 65 or older also violates it: the old annuity incurs a surrender charge and the new one lacks a substantial lifetime financial benefit such that a reasonable person would consider the purchase unnecessary. Patterns of replacements following applications denying replacement create rebuttable presumptions of agent knowledge and intent to violate the article.
Noncompliance can bring penalties; signatures do not excuse misleading advice. The senior insurance article separately provides administrative penalties and court remedies for its violations. Source limitation: the supplied excerpts omit the replacement penalty schedule, so specific fine amounts are not stated.
