Know your professional boundary

A real estate license authorizes brokerage work; it does not establish expertise in every property type or authorize legal, engineering, or tax advice. Competent practice means recognizing a knowledge gap, obtaining appropriate assistance, and referring specialized questions to qualified professionals. If the needed competence cannot be supplied, decline the work.

Texas's competency rule requires knowledge of local market conditions, industry developments, and the characteristics of the property type, along with judgment and skill in brokerage activities. Residential experience alone does not establish competence to broker a complex industrial facility.

Information versus legal advice

Distinguish factual information and authorized form completion from legal judgment. Entering the parties' agreed price into an authorized blank is different from drafting a new remedy. Explaining an informational choice is different from deciding whether a disputed contract is enforceable. Disclose known pertinent facts; do not turn those facts into an opinion about the validity of title.

Texas generally requires the applicable mandatory TREC contract form, subject to specified exceptions. An exception to form use does not authorize practicing law. Texas prohibits drafting or recommending language defining the parties' rights, obligations, or remedies, including custom escalation, appraisal, and contingency clauses. A special-provisions space does not change that boundary.

First ask whether you have the competence for the assignment. A knowledge gap leads to qualified assistance or referral. With competence established, identify the requested act. Factual information can support authorized form completion. Legal judgment requires the client to consult an attorney.
Check competence, then distinguish factual completion from legal judgment.

Act on the boundary

For example, a buyer asks you to enter an agreed purchase price and also write a clause guaranteeing a lawsuit remedy if the seller defaults. The price belongs in the authorized form's informational blank. The custom remedy requires the buyer's attorney. In Texas, a principal's specific written instructions can permit conspicuous additions or deletions, but that permission does not authorize the license holder to originate or recommend legal language.

Texas also requires advising principals to consult an attorney before execution when unusual matters need legal review or an instrument must be acknowledged and recorded. Advise principals that the instrument they are about to execute is binding. Do not discourage counsel or obtain legal advice from counsel for a principal while acting as that principal's agent. The principal should consult the attorney directly; Texas permits reimbursement of the principal's attorney fees and separate counsel representing only the license holder.

Exact form-completion permissions vary by jurisdiction. For exam questions, identify whether the requested act supplies facts, requires missing brokerage expertise, or determines legal rights, then choose the appropriate assistance before proceeding.
