The appraisal process and federal oversight of appraisal

From a question to a supported opinion
An appraisal develops an opinion of value for a defined property interest as of an effective date. The effective date describes when the value applies; it need not be the report date. Begin by identifying the client, intended users, intended use, property and rights appraised, type and definition of value, effective date, and relevant assignment conditions. Determine a scope of work sufficient to produce credible results.
Gather and verify property, neighborhood, market, sales, cost, and income data as appropriate. Analyze highest and best use: a use must be legally permissible, physically possible, financially feasible, and maximally productive. Apply the relevant valuation approaches. Sales comparison analyzes comparable transactions; cost considers land value plus improvement cost less depreciation; income converts anticipated benefits into value. The assignment and available evidence determine which approaches are necessary.
Reconcile the indications by judging their reliability and relevance, rather than mechanically averaging them. Then communicate the conclusion and its supporting analysis in the appraisal report. For example, reliable comparable sales may deserve greater weight for a typical house, while reliable income evidence may deserve greater weight for a leased investment property.
Federal framework and distinct responsibilities
Title Eleven of the Financial Institutions Reform, Recovery, and Enforcement Act, commonly called FIRREA, protects federal financial and public policy interests through written appraisals, uniform standards, demonstrated competency, and effective supervision. This purpose is stated in 12 U.S.C. § 3331. Under 12 U.S.C. § 3350, a federally related transaction involves a qualifying federal regulatory connection and requires an appraiser's services. Not every property sale or mortgage requires a licensed or certified appraisal under this framework; applicable exemptions and transaction rules matter.
Section 3350 describes a written appraisal as an independent, impartial opinion of defined value for adequately described property on a specific date, supported by relevant market information. A requested loan amount is not a substitute for that analysis.
Keep the organizations separate. The Appraisal Foundation is a private nonprofit organization. Its Appraisal Standards Board develops the Uniform Standards of Professional Appraisal Practice, or USPAP; its Appraiser Qualifications Board establishes minimum qualification criteria. State agencies license or certify appraisers and enforce applicable requirements. The Appraisal Subcommittee, within the Federal Financial Institutions Examination Council, monitors state appraiser regulatory programs. Federal financial institution regulators establish appraisal requirements for transactions within their authority. An appraisal management company coordinates assignments and related services; it does not replace the appraiser's independent judgment.
Remember the division: appraisers develop opinions, standards guide practice, qualification criteria address competency, state agencies credential practitioners, and federal oversight monitors the regulatory framework.
