Casualty loss

Under General Obligations Law § 5-1311, before title or possession transfers, material destruction without buyer fault prevents the seller from enforcing and lets the buyer recover payments; an immaterial loss leaves enforcement with a price abatement. After transfer, the buyer still owes payment.
